THE ENTRY ON THE ROMANIAN TERRITORY
§ European Union citizens can enter Romanian territory
under the condition of presenting the national identity document, the
passport or other valid document issued by the Romanian authorities for
the European Union citizens, without placing the entry stamp by the
Border Police.
§ The family members who are not European Union citizens
are allowed to enter on Romanian territory when presenting a valid
passport and an entry visa (granted on accelerate procedure), exempt the
cases where the requirement of obtaining the visa is repealed under laws
provisions. If the family member is holder of a document attesting
his/hers residence on territory of another Member State as family of a
European Union citizen, he/she is exempt the requirement of obtaining
entry visa.

Romanian visa
Foreign
citizens traveling to Romania should preliminarily obtain the visa from
a Romanian embassy or consulate, except for those originating from
countries with which Romania concluded agreements for visa requirement
annulment, or for which it unilaterally gave up to visa compulsoriness.
Romanian visa is
granted by diplomatic missions and consular offices of Romania from
abroad, based on the preliminary approval of the Ministry of Foreign
Affairs.
Diplomatic missions
and consular offices of Romania abroad may grant short stay visas,
without the preliminary approval of the Ministry of Foreign Affairs, to
those foreigners who do not need a visa to entry on the territories of
the states members of the European Union, provided that these apply for
visas in the country whose citizens they are.
As regards foreign
citizens who should submit an invitation in order to apply for an entry
visa to Romania, the Ministry of Foreign Affairs will grant the
concerned visa only after the issuance by the Authority for Foreigners,
within 30 days since the receipt of the application, of the favorable
approval.
Visa may be issued
for one or more trips, and the long stay ones will only be granted with
the approval of the Authority for Foreigners.
The Romanian Border
Police may grant in the border crossing points the short stay visa and
the transit visa, only in the following situations:
-
in
case of emergency, determined by disasters, natural hazards, or
accidents;
-
in
case of decease or serious sickening of the close relatives,
substantiated with the appropriate documents;
-
in
the case of the crews and passengers of the ships or airships, found
in difficult situations, which need to handle alongside or to land
as a result of some defections, bad weather conditions or a danger
of a terrorist attack;
-
in
the case of the clerks belonging to some international
organizations, who were delegated to fulfill official missions in
Romania in a short interval of time;
-
in
the case of the foreign seafarers supposed to be repatriated upon
termination of the work contract, or in case of effectuation of the
shift of crews.
Conditions
referring to visa request:
Visa applications
should be accompanied by the valid state border crossing document (the
validity of the travel document on which visa should be affixed should
exceed the validity of the requested visa by at least 6 months), on
which visa can be applied, by the documents attesting for the travel
purpose and conditions, as well as by the evidence attesting for the
existence of the financial means required for subsistence during the
stay in Romania and also in order to leave the territory of Romania.
There may be
accepted as subsistence means the amounts of money in convertible
foreign currency, travel cheques over an account in foreign currency,
credit cards with the account statement for these, issued with two days
the most before the visa request, or any other means which can prove the
existence of the appropriate financial means.
Upon requesting
entry visa to Romania, foreigners should appear in person before the
authorities competent to grant visa.
The visa categories
issued by the Romanian authorities are the following:
·
airport transit visa,
with a right to stay of 5 days - symbol A;
·
transit visa,
with a right to stay of 5 days - symbol B or B/CL, when it is about a
collective visa - this is granted to
applicants under the following circumstances:
- whenever these
are holders of the visa of a third state and, if necessary, of a state
limitrophe to Romania, which allow foreigners to continue their trip;
- whenever these
are in possession of a travel ticket up to destination or whenever these
produce the driving licence, the green card and the registration
documents of the transportation vehicle, as far as car drivers are
concerned. Exempt from meeting this term are the persons who accompany
the car drivers, traveling together with these.
·
the
short stay visa,
with a right of sojourn of 90 days, identified through one of the
following symbols, depending on the activity supposed to be performed in
Romania by the foreigner to whom this was granted:
§
mission
- symbol C/M - granted to those foreigners who
can produce proof that they fulfill functions within governments, public
administrations or international organizations, as well as for those
who, by means of their stay in Romania, present interest for the
relations between the Romanian state and the state of origin and are
traveling to Romania by virtue of these qualities;
§
tourism
- symbol C/TU or CL/TU, whenever it is about a collective visa -
this is granted to foreigners if these can
present:
- the voucher or a
firm reservation at a unit of tourist accommodation;
- the trip ticket valid until
destination or the driving licence, the green card and the documents of
registration of the transportation vehicle, as far as car drivers are
concerned;

the medical insurance;
- the proof attesting the existence of the
financial means necessary for subsistence in quantum of EUR 100 / day or
the equivalent value in convertible foreign currency, for the entire
period;
§
visit
- symbol C/VV - this is granted to
foreigners if these can present:
- the trip ticket
valid until destination or the driving licence, the green card and the
documents of registration of the transportation vehicle, as far as car
drivers are concerned;
-
the medical insurance;
- the proof attesting the
existence of the financial means necessary for subsistence in quantum of
EUR 100 / day or the equivalent value in convertible foreign currency,
for the entire period;
- evidence of accommodation, in the form of a
firm reservation at an accommodation unit, of a property deed or of a
rent contract for a house in Romania on the name of the applicant or, as
the case may be, of a notarial declaration of the visited person,
accompanied by the legalized copy of the space attesting documents;
§
business
- symbol C/A - this is granted to
foreigners if these can present:
- the trip ticket
valid until destination or the driving licence, the green card and the
documents of registration of the transportation vehicle, as far as car
drivers are concerned;
-
the medical insurance;
- justifying documents regarding
the purpose of the trip;
- the proof attesting the
existence of the financial means necessary for subsistence in quantum of
EUR 100 / day or the equivalent value in convertible foreign currency,
for the entire period;
- evidence of accommodation;
§
transportation
- symbol C/TR - this is granted to foreigners if these can present:
- documents
attesting the profession of the applicant, as well as the activity
supposed to be performed during the stay;
-
the medical insurance;
- the driving licence, the green
card and the registration documents of the transportation vehicle;
- the transportation license and
the execution license;
§
sportive activities
- symbol C/SP - this is granted to
foreigners if these can present:
- the invitation of
the organizers, supposed to attest the medical insurance and
accommodation;
- the official list of the
foreign sportive delegation, with the specification of the quality of
every member;
- the approval of the county directorate for
sports, competent from the territorial point of view;
§
cultural, scientific, humanitarian activities, short term medical
treatment or other activities not going against the Romanian legislation
- symbol C/ZA - this is granted to
foreigners if these can present:
- documents issued
by the institutions where they are to travel in order to justify the
presence in Romania;
- the trip ticket valid until
destination or the driving licence, the green card and the documents of
registration of the transportation vehicle, as far as car drivers are
concerned;
- the proof attesting the
existence of the financial means necessary for subsistence in quantum of
EUR 100 / day or the equivalent value in convertible foreign currency,
for the entire period;
-
the medical insurance;
- evidence of accommodation;
o
the
long stay visa,
with a right to stay of 90 days, with the possibility to extend it by 90
days the most, identified through one of the following symbols,
depending on the activity supposed to be performed in Romania by the
foreigner to which this was granted:

RESIDENCE
European Union citizens, who enter the Romanian territory, shall benefit
of residence right for a period up to 3 months from the date of entry in
our country. The family members of European Union citizens, regardless
their citizenship, who accompany or join them subsequently, shall be
beneficiaries of the same right of residence.
The
right of residence for a period longer than 3 months
For a
stay longer than 3 months, the European Union citizens have to register
their residence to the territorial branches of Authority for Aliens in
one of the following situations:
-
They carry out dependent or independent activities, according
to the law;
-
They have means of support for themselves and for their
family members, regularly at least the guaranteed minimum income
level in Romania and they have health insurance recognised by
the national system of health social insurances;
-
They are registered at a private or public institution in Romania,
accredited according to the law, having as main purpose
educational or vocational training activities, they have health
insurance recognised by the national system of health social
insurances and they declare under own liability or confirm by other
means of proof that they have means of support for
themselves and for their family members at least at the guaranteed
minimum income level in Romania;
-
They are family members of a European Union citizen which
fulfils one of the above-mentioned conditions.
Family
members who are not European Union citizens
can
benefit of residence right for a period longer than 3 months, if they
accompany or join subsequently the European Union citizen who fulfils
one of the above-mentioned conditions.
The
right of permanent residence
The
European Union citizens who have a continuous legal residence on
Romanian territory of more than 5 years shall benefit of the right of
permanent residence. The same right shall be granted to residents who
are not European Union citizens with a continuous legal stay of more
than 5 years, as family members of a resident or permanent resident who
is European Union citizen.
Documents attesting residence on Romanian territory
Documents attesting the residence longer than 3 months:
-
Registration certificate for European Union citizens (which is
issued in the day of submission the application),
-
Residence card for family members who are not European Union
citizens.
Documents attesting the permanent residence:

Permanent residence card for European Union citizens
-
Permanent residence card for family members who are not European
Union citizens
*All
documents issued to European Union citizens and their family members are
handed over to holders after they cover the costs of issuing the
documents, the cost for issuing procedures as well as, if the case may
be, other fees and taxes established under the provisions of law, which
are also applicable to Romanian citizens.
Limits
of maintaining the right of residence
Authority for Aliens can check the fulfilment of requirements for
exercise the right of residence by the European Union citizens and their
family members. Against the European Union citizens and their family
members who do not fulfil any longer the conditions for exercise the
right of residence, the Authority for Aliens may issue an order of
leaving Romanian territory, without ordering in the same time the
interdiction of entry on Romanian territory.
RESTRICTION OF THE RIGHT OF FREE MOVEMENT ON ROMANIAN TERRITORY ON
GROUNDS OF PUBLIC ORDER, NATIONAL SECURITY OR PUBLIC HEALTH.
Romanian authorities may restrict the exercise of the right of free
movement on Romanian territory by the European Union citizens or their
family members only on grounds of public order, national
security or public health.
-
Declaration as undesirable
– represents a measure ordered against a European Union citizen or
his/hers family members who performed or there are serious
indications that he/she intends to perform such activities as to
endanger the national security and public order. The measure shall
be decided by the Court of Appeal of Bucharest, upon request of the
appointed prosecutor from the Prosecution Department affiliated to
the above-mentioned court.
-
Expulsion
– the measure may be ordered under the conditions provided by
the Penal Code and the Penal Procedure Code against the European
Union citizen or his/hers family member who committed a crime on
Romanian territory.

Removing on grounds of public health
–
the measure may be ordered by the Authority for Aliens upon request
of specialised institutions within the Ministry of Health, only in
the case a disease established by order of minister of health is
discovered on the basis of the results of medical investigations
undertook by the person concerned within no more than 3 months of
the date of arrival.
2. Acts and documents necessary for family reunification:
a.
The copy of the stay permit of the alien who has formulated the
application.
b.
The copy of the state border crossing document belonging to the alien
for who is requested the admission on the Romanian territory.
c.
The marriage certificate/birth certificate (translated and legalized),
or other documents attesting the kinship, issued by the relevant
authorities.
Note: The Chinese marriage certificates that will be used in
Romania must be supra-legalized by the Consular Department of Foreign
Affairs Ministry of Chinese Popular Republic and the Romanian Embassy or
Consulate from Chinese Popular Republic
d.
The applicant’s statement (translated and legalized) attesting the
kinship, issued by the relevant authorities.
e.
The proof of the means of support.
f.
The proof of the dwelling space (original/copy).
g.
The medical insurance of the applicant (original/copy).
